1. Agreement
By registering for the Pres Les Affiliate Program, you agree to be bound by the terms and conditions below.
2. Enrolment in the Program
To enrol in the Pres Les Affiliate Program, you must complete your registration on the Pres Les Affiliate portal. We will verify your details and process your registration. Pres Les reserves the right to reject your registration if the partnership is deemed unsuitable.
3. Promotion and Link Placement
Affiliates may use links, banners, and other promotional materials provided by Pres Les. Affiliates are permitted to place these links on their websites and in emails, communications, or social media posts, provided they comply with applicable laws and the terms of this agreement.
4. Use of the Affiliate’s Personal Information by Pres Les
Pres Les may use the personal information of the Affiliate, which is submitted by the Affiliate to Pres Les, for purposes of enabling Pres Les to register make use of the services of the Affiliate as described in these terms. Without limiting the aforesaid, the Affiliate consents that Pres Les may contact the Affiliate for all purposes in connection with the Affiliates registration to the Pres Les Affiliate Program via the following channels:
4.1.1. telephonically; or
4.1.2. by email; or
4.1.4. via WhatsApp or SMS.
5. Commissions
Affiliates will earn a 5% commission on the net product value* of all accepted orders made through their referral links. An accepted order is defined as an order that has been successfully processed and not cancelled, rejected, or returned.
*Net order value is the value of the order after discounts are applied and excluding VAT and delivery fees. Please note that delivery fees for countries other than South Africa include customs VAT and import fees associated with that country.
6. Payment
Pres Les sales periods run from the 11th of a month to the 10th of the following month. Affiliate commission payment will be made on the 14th of the month (or 3 business days after the 11th of the a month) for the preceding sales period and will be paid directly to the affiliate. It is the affiliate’s responsibility to ensure that bank details are up to date and correct.
7. Affiliate Responsibilities
Affiliates are responsible for ensuring that their promotional activities comply with all applicable laws and regulations.
8. Prohibited Activities
Affiliates are prohibited from:
- Using unethical or illegal promotional methods, including spam, false advertising, or trademark infringement.
- Offering any person or entity any kind of incentive for purchasing through an affiliate link.
- Misrepresenting the relationship between the affiliate and Pres Les.
9. Termination
Pres Les reserves the right to terminate the affiliate's participation in the program at any time, with or without cause. Upon termination, the affiliate will be removed from the program and will no longer receive commissions for any future sales.
10. Limitation of Liability
Pres Les will not be liable for any indirect, special, or consequential damages arising in connection with this agreement or the affiliate program.
11. Modification
Pres Les reserves the right to modify these terms and conditions at any time. Affiliates will be notified of any changes via email. Continued participation in the program after such changes will constitute acceptance of the new terms.
12. Governing Law
This agreement will be governed by the laws of South Africa, without regard to its conflict of laws principles.
13. Legal Considerations
a. Consumer Protection Act Compliance: Affiliates must ensure that all marketing activities comply with the Consumer Protection Act, 2008, which protects consumers against unfair marketing practices.
b. Electronic Communications and Transactions Act (ECTA): Affiliates must ensure that any electronic communications, including emails and social media posts, comply with ECTA, 2002, which governs electronic transactions in South Africa.
c. Protection of Personal Information Act (POPIA): Affiliates must handle personal data in compliance with POPIA, 2013, which regulates the processing of personal information.
d. Intellectual Property Laws: Affiliates must be aware of and comply with South Africa's intellectual property laws, including trademark and copyright laws, to avoid any infringements.
e. Anti-Spam Legislation: Affiliates must comply with anti-spam legislation, ensuring that all electronic communications are lawful and not considered spam.
f. Dispute Resolution: Any disputes arising under this agreement will be resolved through arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
